LEGAL FRAMEWORK IN CYPRUS

WHAT RIGHTS GRAMMO REPRESENTS AND WHAT LICENSES GRANTS

According to the Intellectual Property Law in Cyprus 59/1976 and 65(I)/2017, as it exists, the copyright holders of recordings and films- videoclips- as far as the record companies are concerned, i.e GRAMMO, has the exclusive right to permit or deny, among others:

  • direct or indirect reproduction of the recordings
  • lending, borrowing and distribution of the original or copies thereof
  • radio and tv broadcasting, communication to the public through satellite
  • cable retransmission
  • communication to the public, through wires or wireless means and
  • making their recordings available

So, every time that music/recording is being publicly performed/communicated in public- public places, such as, in cafes, café-bars, clubs, hotels and guest houses, restaurants, places for events, hair salons and beauty salons, cinemas, offices, factories, calling centers, or in radios or tv broadcasting, is considered as public performance/ communication to the public.

For this public performance/communication to the public, a LICENSE is required from all the rightholders that are engaged in the production of music who hold the copyright, i.e. those who created it (authors/composers-PRS) and those who contributed to its production in a way that it can be accessible by you (record companies- GRAMMO). Also, the rights to performers should be paid (neihgboring rights).

So, it is obvious that the users of such recordings, s h o u l d and are o b l I g e d, to pay the relevant remuneration and to get the license from GRAMMO, prior to such use. With this license, the relevant non-exclusive right will be granted for the afore mentioned lawful use, such as radio and tv broadcasting, communication to the public through satellite, cable retransmission, communication to the public, through wires or wireless means etc.
